Notation based on the Specified Commercial Transaction Act

Dai-ichi Seiko Co., Ltd. (hereinafter referred to as “Dai-ichi Seiko”) shall, pursuant to this email order terms of use (hereinafter referred to as "the terms"), provide an email order service (hereinafter referred to as “the service”) of products listed at the Dai-ichi Seiko Webstore (hereinafter referred to as “the webstore”). Those who use the service are requested to read the terms carefully and be sure to understand the contents of the terms in advance.

1. Notes concerning the seller and sales conditions

Dai-ichi Seiko shall be the seller of each product (including the dealership of each product, hereinafter referred to as “the product”) handled pursuant to the terms.
The conditions stipulated in the terms and other conditions specified on a product-by-product basis on the website shall apply to product sales and purchases.

2.Ordering method

Each customer placing a purchase order (hereinafter referred to as “the order”) shall enter the order on a webpage specified by Dai-ichi Seiko and send the order online through the Internet (hereinafter referred to as “the online order”).

3.Notes on order

The information on the destination of the product, customer’s name and telephone number, contents of the order, etc. entered on Dai-ichi Seiko’s information entry page (hereinafter referred to as “the entry page”) in the process of placing the order will appear on a content confirmation page for the customer’s confirmation of the entry contents. The order shall be processed according to the information entered on the entry page and transmitted online to Dai-ichi Seiko. Accordingly, the customer is requested to confirm the contents of input on the entry page and details of the order. Dai-ichi Seiko shall not be responsible for any mistakes in the contents of the customer’s order transmitted online to Dai-ichi Seiko, including but not limited to the cancellation or amendment of the order, unless such mistakes are caused by Dai-ichi Seiko’s fault.

4.Price

As a general rule, the price of each item listed on any of Dai-ichi Seiko's webpages is a unit price that excludes consumption tax.

5.Payment method and timing

5-1.Cash on delivery

This is a method of paying where delivery person is paid in cash the price, shipping charge, and delivery commission for the delivered product.

5-2.Credit card

The customer may use his/her own credit cards for payment. The customer needs to enter his/her credit card number along with its expiration date and security code on the card information input page according to Dai-ichi Seiko’s guidelines. Credit cards available are VISA, Mastercard, JCB, American Express, and Diners Club cards. The customer’s payment by card shall be made in accordance with the membership agreement of the credit card company. * Security code: The security code is the last three digits printed in the upper part of the signature field on the back of the card. If the number is 1234 5678 1234 5678 111 in the signature field, 111 is the security code.

6.Notes on trading

6-1.Establishment of sales agreement

The sales agreement between a customer and Dai-ichi Seiko shall come into effect at the time the formal order procedure specified below is completed by Dai-ichi Seiko for the product ordered by the user. Dai-ichi Seiko may contact the customer over the phone as necessary to confirm the customer’s payment method and order details.

6-2.The customer's method of payment shall be determined upon the completion of the formal order procedure.

6-3.If the customer selects to pay by cash on delivery, the completion of the formal order procedure shall be the time Dai-ichi Seiko receives information on the content confirmation page from the customer.

If the customer selects credit card payment, the completion of the formal order procedure shall be the time the customer’s use of the credit card is authorized by the credit card company.

6-4.Amendment or cancellation

The customer shall not amend the contents of the order or cancel the order after the formal order procedure is completed. Dai-ichi Seiko shall allow the customer to amend the content of the order or cancel the order before the formal order procedure is completed by sending an email to or by calling Dai-ichi Seiko’s customer relations office.

6-5.Those who need consent to order

If the customer is under the age of 20, the customer shall need the consent of the customer’s parent or guardian to place an order.

7.Product delivery

Dai-ichi Seiko shall ship a product within two business days after accepting the order. The product ordered shall be shipped by a distribution business specified by Dai-ichi Seiko. Depending on the product, Dai-ichi Seiko may change or delay the product delivery schedule or cancel the acceptance of the order due to unavoidable circumstances. In that case, the customer shall agree that Dai-ichi Seiko shall not be held responsible for any damage caused by the change from the delivery date initially set. The customer relations office shall inform the customer if the product's shipping schedule changes significantly. Dai-ichi Seiko may change the shipping destination at the customer’s request. However, in this case, Dai-ichi Seiko may claim an additional shipping charge and commission from the customer. If the product is returned to Dai-ichi Seiko because the customer did not receive the product within the period specified by the distribution business, Dai-ichi Seiko may arrange the return of the product, provided that the customer bears the return shipment charge and expenses.

8.Transfer of ownership

As soon as a product is delivered to the customer or the customer’s designated shipping address, the ownership of the product shall be transferred from Dai-ichi Seiko to the customer. If the customer chooses credit card payment, the membership agreement of the credit card company shall take precedence. Except where Dai-ichi Seiko is responsible, the customer shall bear the burden of loss of the product upon receipt of the product ordered.

9.Product shortage or difference

If there is a shortage or mistake in a delivered product, the customer shall contact Dai-ichi Seiko’s customer relations office by phone or email within seven days from the date of receipt of the product, and Dai-ichi Seiko shall ship the supplement or the correct product ordered. The customer shall be deemed to have received the product ordered without trouble if the customer does not notify Dai-ichi Seiko within seven days from the date of receipt of the product. The customer shall not withhold the payment of the product while Dai-ichi Seiko is confirming the customer’s notification. The customer shall take delivery of the product within seven days from the shipping date. Dai-ichi Seiko may cancel the sales agreement if the product is not received within the specified period. Dai-ichi Seiko shall notify the customer in writing or by email if Dai-ichi Seiko cancels the sales agreement. The customer shall not be able to claim the refund of the product price unless the customer contacts Dai-ichi Seiko for the refund within seven days after the notification.

10.Returns/Exchanges

10-1.Returns

In principle, Dai-ichi Seiko shall not accept the return of any product for reasons of convenience to the customer.

10-2.Exchanges

Dai-ichi Seiko shall exchange a product if the customer has purchased it by mistake. In this case, the customer shall contact Dai-ichi Seiko by telephone within seven days after the product reaches the customer and return the product promptly to the address specified by Dai-ichi Seiko. The product shall be exchanged with the correct product, provided that the customer pays the shipping charge. Dai-ichi Seiko shall assume that the customer has withdrawn the exchange request if Dai-ichi Seiko cannot confirm the return of the product within 15 days of being contacted by the customer. Dai-ichi Seiko shall not accept the exchange of the product in any of the following cases: The product has been unpacked or used, the product has scratches or other damage due to reasons not attributable to Dai-ichi Seiko’s responsibility, the customer did not contact Dai-ichi Seiko by telephone about the exchange within seven days after the customer took delivery of the product, or the product is a specific item designated by Dai-ichi Seiko.

11.Warranty

Warranty service for a product shall be provided according to the conditions stated on the warranty card. The warranty conditions of the product may be specified in the corresponding webpage. The customer should confirm the contents carefully.

12.Handling of personal information

Dai-ichi Seiko shall use information to identify specific individuals (hereinafter referred to as “personal information”) collected from each customer through transactions based on this service and information on transactions, including the transaction history of the customer, (hereinafter referred to as “transaction information”) only for the purposes described below. Unless otherwise specified by laws and regulations, Dai-ichi Seiko shall not use personal information or transaction information without the prior consent of the customer. Dai-ichi Seiko shall not provide personal information to third parties without the consent of the customer, except for the following cases: 1. Disclosure of personal information to third parties in accordance with laws and regulations. 2. Disclosure of personal information to credit card companies at the request of the credit card companies in order to prevent third parties’ unauthorized use of the credit cards (including the disclosure of personal information from credit card companies to their affiliates issuing credit cards).

13.Limitation of liability

Unless otherwise specified in the terms specified herein, Dai-ichi Seiko shall not be held responsible for any direct or indirect damage to customers or third parties resulting from the use of products, except for cases attributable to Dai-ichi Seiko. Furthermore, Dai-ichi Seiko shall not assume liability beyond the total price of any product or service unless there is deliberate or gross negligence on Dai-ichi Seiko’s part. Dai-ichi Seiko may correct clerical errors in sales information, if any, on its website, quotations, or other documents. In addition, Dai-ichi Seiko may cancel orders of products or orders in which any clerical errors are found. Dai-ichi Seiko shall not be held responsible for any delay or failure in delivering products due to natural disasters, accidents caused by transportation agencies, communication obstacles, any revision or abolition of laws and ordinances, or other unavoidable circumstances. Data, if any, recorded and saved in products received from customers for repairs, shall be backed up or erased by the customers. Dai-ichi Seiko shall not guarantee the maintenance of such data.

14.Other

It shall be understood that products appearing on the screen may differ in color tone from actual products. If a customer’s data is lost due to malfunctioning or trouble with equipment providing this service or due to communications line failures, Dai-ichi Seiko may immediately invalidate or cancel the sales agreement. It shall be understood that the customer's email may be lost or Dai-ichi Seiko may not be able to receive the customer's email in time due to system failures. The customer shall withstand any damage caused by the lost email or the delay in the delivery of the email. This agreement is subject to change without notice. The customer is requested to confirm the contents of changes, if any, in each of Dai-ichi Seiko’s webpages. The previous terms shall apply to products ordered prior to changes in the sales agreement. If it is not possible for a customer and Dai-ichi Seiko to solve a problem in connection with the service, the Osaka Summary Court or the Osaka District Court, depending on the amount sued for, shall be the exclusive agreement jurisdictional court.
